1. Scope

These general terms and conditions apply to all contests that NELLA & SINA conducts via the Instagram account @nellaundsina organized, unless different regulations are specified in the respective contest entry.

The respective contest entry is part of these terms and conditions. The contest entry specifies in particular the prize, the number of winners, the participation period, the participation requirements, and, if applicable, further details of the respective contest.

Participation is voluntary and free of charge. It is not dependent on the purchase of goods or services.

By participating, participants acknowledge these terms and conditions and the privacy information.

If a contest is conducted jointly with another organizer, this will be explicitly named in the respective contest entry.

Simply sharing, promoting, or supporting a contest by influencers, brands, or other third parties does not make them organizers of the contest.

3. Note on Instagram

The respective contest is not connected to Instagram in any way and is not sponsored, supported, or organized by Instagram.

The contact person and responsible party for conducting the contest is exclusively NELLA & SINA or a co-organizer explicitly named in the contest entry.

Participants indemnify Instagram to the legally permissible extent from all claims that may arise in connection with the conduct of the contest.

4. Eligibility to Participate

Eligible to participate are natural persons who are at least 18 years old at the time of participation and have their residence in the participation area specified in the respective contest entry.

The specific participation area is explicitly stated in the respective contest entry. A contest may be limited in particular to the following areas:

• Germany
• Germany, Austria, and Switzerland
• Member states of the European Union
• other countries explicitly named in the respective contest entry

If no different participation area is specified in the contest entry, participation is limited to persons residing in Germany.

Employees of NELLA & SINA, persons directly involved in the conception or execution of the contest, as well as their household members, are not eligible to participate.

5. Participation

The specific type of participation is determined by the respective contest entry.

The participation actions specified there must be fully completed within the stated participation period. These may include following the Instagram account, liking or commenting on a post, or other actions clearly described in the contest entry.

Unless otherwise stated in the contest entry, only one entry per person is allowed.

Using multiple Instagram accounts to increase chances of winning is not permitted. Participation via automated processes, bots, contest services, or similar technical aids is also excluded.

The time of participation documented on Instagram is decisive for the timeliness of the entry.

6. Participation Period

The start and end of each contest are specified in the contest entry.

Entries made before the start or after the end of the specified participation period cannot be considered.

7. Prize

The type, scope, and number of prizes are specified in the respective contest entry.

Cash payment, interest, or transfer of the prize claim to another person is excluded unless otherwise stated in the respective contest entry.

If a promised piece of jewelry is no longer available for reasons beyond NELLA & SINA's control, an equivalent replacement may be offered to the winners.

8. Determination of Winners

Winners will be determined after the participation period has ended from all valid entries.

If no other selection procedure is specified in the respective contest entry, the winners will be determined by random draw.

Legal recourse regarding the conduct of the draw and the determination of winners is excluded, as far as legally permissible.

9. Prize Notification

Winners will generally be notified via direct message through the official Instagram account @nellaundsina notified.

If a different notification method is specified in the respective contest entry, notification will be made via the method stated there.

Winners must respond within five calendar days after the prize notification is sent and provide the information required for prize delivery.

If no response is received within this period, the claim to the prize may be forfeited and the prize may be redrawn among the remaining valid entries.

Public disclosure of the name or Instagram username will only occur if the affected person has previously given explicit consent.

10. Handover and Shipping of the Prize

For shipping a physical prize, the name and full delivery address of the winner are particularly required.

Shipping will be made to the provided address. Winners are responsible for ensuring that the information provided is complete and correct.

If necessary for delivery, shipping data will be transmitted to the shipping company commissioned with delivery or to a cooperation partner named in the giveaway post.

If a prize cannot be delivered due to incomplete or incorrect information, NELLA & SINA is not obliged to resend it. In this case, NELLA & SINA may select a replacement winner.

11. Exclusion from Participation

NELLA & SINA may exclude participants from a giveaway if there is a factual reason for doing so.

Exclusion may particularly occur in cases of:

• manipulations or attempts at manipulation,
• participation via multiple accounts,
• use of false or misleading information,
• violations of these terms of participation,
• illegal, offensive, or discriminatory content,
• violation of third-party rights,
• participation via bots or automated giveaway services.

If the prize has already been promised or delivered, it can be reclaimed in the event of a subsequently determined exclusion reason, as far as legally permissible.

12. Change or Early Termination

NELLA & SINA may change, interrupt, or terminate a giveaway early for an important reason if proper execution can no longer be guaranteed.

An important reason may particularly exist in cases of technical malfunctions, manipulations, security issues, changes to Instagram functions, or legal obstacles.

A change or termination will not be made arbitrarily. The legitimate interests of the participating persons will be appropriately considered.

Significant changes will be announced in the respective giveaway post or via the Instagram account @nellaundsina informed.

13. Data Protection Information

13.2 Processed Data

As part of an Instagram giveaway, the following personal data in particular may be processed:

• Instagram username,
• Publicly visible profile information,
• Comments, likes, and other participation actions,
• Time of participation,
• Messages related to the contest,
• For winners, additionally name, contact details, and delivery address.

Only data necessary for conducting the respective contest is processed.

13.3 Purposes and legal bases

Personal data is processed to:

• To verify participation requirements,
• To conduct the contest,
• To determine the winners,
• To notify the winners,
• To deliver the prizes,
• To prevent manipulation and fraudulent participation.

Processing for conducting the contest is based on Art. 6 para. 1 lit. b GDPR.

Processing to prevent and investigate manipulation or fraudulent participation is based on our legitimate interest in a proper and fair conduct of the contest according to Art. 6 para. 1 lit. f GDPR.

Where legal obligations exist, processing is based on Art. 6 para. 1 lit. c GDPR.

Public announcement of winners only occurs based on a separate consent according to Art. 6 para. 1 lit. a GDPR.

13.4 Recipients of the data

Personal data is only shared to the extent necessary for conducting the contest, delivering the prize, or fulfilling legal obligations.

Recipients may include, in particular:

• Contracted shipping companies,
• Technical service providers,
• Cooperation partners explicitly named in the contest entry, provided they ship the prize directly,
• Authorities or other public bodies, if there is a legal obligation.

When using Instagram, personal data is also processed by Meta. NELLA & SINA does not have full control over the nature and scope of this data processing.

13.5 Necessity of providing data

The actions and information required for participation are derived from the respective contest entry.

Participation in the contest is not possible without the participation actions mentioned there.

Winners must provide the contact details required for prize handover or shipping. Without this information, the prize cannot be handed over or shipped. In this case, a substitute winner may be determined.

13.6 Storage duration

Data of participating persons stored separately by NELLA & SINA outside Instagram who do not receive a prize will generally be deleted no later than three months after the complete conclusion of the contest.

The data of the winners will be deleted as soon as the prize has been fully handed over or delivered and the data is no longer needed.

Longer storage only occurs if legal retention obligations exist or the data is necessary for asserting, exercising, or defending legal claims.

Publicly visible comments, likes, or other content on Instagram may remain regardless until deleted by the respective person or the relevant contest post is removed.

13.7 Termination of participation

Participants can end their participation until the winners are determined by deleting the respective participation action on Instagram or by emailing NELLA & SINA at kontakt@nellaundsina.de inform.

The person concerned will then no longer be considered in the drawing.

Data processing already carried out remains lawful. Data no longer needed will be deleted in accordance with legal provisions.

13.8 Rights of the data subjects

Affected persons have, subject to legal requirements, in particular the right to:

• Information about the data processed about them,
• Correction of incorrect or incomplete data,
• Deletion of their data,
• Restriction of processing,
• Data portability,
• Objection to processing based on legitimate interests,
• Revocation of a given consent with effect for the future,
• Complaint to a competent data protection supervisory authority.

14. Liability

NELLA & SINA is liable within the framework of legal provisions.

In the case of slight negligence in the violation of essential obligations, liability is limited to foreseeable and typically occurring damage. Otherwise, liability is excluded as far as legally permissible.

Claims under the Product Liability Act remain unaffected.

15. Applicable Law

The law of the Federal Republic of Germany applies.

If a participating person as a consumer has their habitual residence in another state, the mandatory consumer protection regulations of that state remain unaffected.
